The digital tachograph is a mandatory component in much of road transport, and its operation depends on a smart card without which the device cannot correctly record activity. Drivers and companies frequently face the same questions: which card do I need, who is required to carry it, when does it expire and what do I do if I lose it? This article sets those concepts out in a practical way.

1. What the digital tachograph is and what it is for

The tachograph is the device fitted in the vehicle that automatically records driving and rest times, speed and the distances travelled. In its digital version it replaces the old paper charts of the analogue tachograph and stores the information electronically, both in the device's own memory and on the card inserted into it.

Its purpose is twofold: on the one hand, to guarantee compliance with driving and rest times that protect road safety and the driver's working conditions; on the other, to give the authorities a reliable and hard-to-manipulate record of the vehicle's actual activity. Each card is personally identified and the data is linked to whoever is driving.

2. Types of tachograph card

There is not a single card: there are four types, each designed for a different actor in the system. It is important to request the right one, because each grants access to different functions of the device.

Driver card For the person driving. It is personal and non-transferable and records their individual activity: driving, rest and other periods.
Company card For the company that owns or uses the vehicles. It allows the tachograph data to be downloaded and protected and the information to be locked against third parties.
Workshop card For authorised technical centres. It enables the installation, calibration, inspection and repair of the tachograph.
Control card For the control authorities (officers and inspectors). It allows access to the recorded data in order to verify compliance.

For most of our clients the two relevant ones are the driver card and the company card: the first is needed by every person who takes the wheel of an affected vehicle; the second is needed by the company to manage and safeguard its fleet's data.

3. Who is required to use it

The obligation to use a digital tachograph applies, as a general rule, to vehicles used for the road transport of goods or passengers above a certain maximum authorised mass or number of seats. This is the typical case of lorries, tractor units, large vans and coaches.

There are exceptions for certain uses (vehicles for specific services, some short-range own-account transport or vehicles below the established threshold), but it is advisable to check case by case, because the vehicle's classification and the type of transport determine whether the obligation applies. When in doubt, the prudent course is to verify before driving, since liability for not carrying a tachograph or card falls on both the driver and, in many cases, the company.

Practical rule: if the vehicle exceeds the mass or seat threshold set for professional transport, it can be expected to need a digital tachograph and, with it, the corresponding card. Confirm this against the vehicle's technical data sheet and the type of service.

4. Validity and renewal

Each card type has its own period of validity and, once it ends, it can no longer be used. That is why renewal is not something to leave until the last minute: if the card expires without having been renewed, the driver or the company may temporarily be unable to operate normally.

The professional recommendation is to start the renewal well in advance of the expiry date, depending on the card type, so that the new one arrives before the previous one loses validity. The renewal application is similar to a first issuance, with the advantage that the data is already in the system.

An expired driver card cannot be replaced on the spot: the renewal must be requested with a margin. Driving with an expired card is, for practical purposes, the same as driving without one.

5. What to do if it is lost, faulty or stolen

When a card is lost, damaged, stops working properly or is stolen, a replacement must be requested as soon as possible. In cases of theft or loss it is also advisable to leave a record of what happened, since the card is personal and its misuse by a third party can cause problems.

Driving without a card during that period is subject to strict conditions and cannot be prolonged indefinitely: the replacement must be requested immediately.

6. Consequences of not carrying it or carrying it expired

Driving an affected vehicle without a tachograph card, with an expired card or manipulating the system to falsify the records constitutes an infringement in transport matters. The rules provide for financial penalties and, in the most serious cases —manipulation or data fraud—, consequences that can go beyond a simple fine.

Liability does not always rest solely with the driver: the transport company has its own duties to download, safeguard and monitor the data, and failure to comply is also penalised. That is why tachograph compliance should be treated as a shared responsibility between driver and company, not as an isolated individual formality.
