The short answer: if you file Spanish inheritance tax late in Valencia before the Valencian Tax Agency (ATV) asks you to, there is no penalty. You pay a surcharge of 1% plus another 1% for each full month of delay, or 15% plus interest once a year has passed (article 27 of the General Tax Act). And children, spouses and parents keep their 99% allowance, because Valencian law still grants it on returns filed late without a prior demand (article 12 bis.3 of Law 13/1997).

What the deadline was, and whether you can still get an extension
The return is due within six months of the death (article 12 ter of Valencian Law 13/1997). That period can be extended by another six months, but only if you ask within the first five (article 68 of the Inheritance Tax Regulation, Royal Decree 1629/1991). In the Valencia region the request is made on form 739.
- Ask in the sixth month and it will be refused.
- No answer within a month means it has been granted.
- It is not free. You pay late-payment interest from the end of the six months until the day you file.
If five months have not yet passed since the death, you are not late: ask for the extension today.
What you pay if you file late on your own initiative
What matters is who moves first. If you file before the tax office has contacted you, article 27 of the General Tax Act applies:
| Delay after the deadline | Surcharge |
|---|---|
| Less than one full month | 1% |
| Each full month of delay | 1% more (up to 12% at 11 full months) |
| More than 12 months | 15% plus late-payment interest from the day after those 12 months |
The surcharge is worked out on the tax you owe, not on the value of the estate. It replaces any penalty: filing late on your own is not an offence of failing to pay (article 191.1). And no late-payment interest is charged during the first twelve months.
On top of that, the surcharge is cut by 25% if you pay everything shown on the return when you file it, and then pay the surcharge within the period given when it is notified to you (article 27.5). With a deferral, only if it is secured by a bank guarantee or surety insurance.
A worked example: if your tax comes to 2,000 euros and you file three full months late, the surcharge is 4%, or 80 euros. If you pay the tax at the same time, it drops to 60.
What if the return shows nothing to pay? Then there is no surcharge, because there is nothing to pay it on. But filing a return late when no tax is lost is still a minor offence: the fine is 200 euros, halved to 100 if you file without a prior demand (article 198 of the General Tax Act).
If the ATV contacts you first, everything changes
In law, a prior demand is any action by the tax authority that is formally notified to you and aimed at checking, correcting or assessing that tax (article 27.1). A letter from the ATV asking you to file counts. From that moment:
- There is no surcharge any more: they assess the tax with late-payment interest from the end of the deadline.
- They can fine you for failing to pay. The minimum penalty is 50% of the unpaid tax (article 191.2), reduced if you accept the assessment and pay promptly (article 188).
- And you lose the allowance on whatever you had not declared.
Do I lose the 99% allowance by filing late?
No, if you file before any demand. Yes, if you wait for them to write.
In the Valencia region, groups I and II (descendants, spouse and ascendants) get a 99% allowance on the tax due. Brothers, sisters, nephews, nieces, uncles and aunts by blood (group III) get 25% for deaths from 1 June 2026. Both apply only to assets that have been "declared" (article 12 bis of Law 13/1997). Section 3 of that article spells out what that means: assets fully included in a return filed on time, or filed late without a prior demand from the authority.
Put simply: file late but on your own and you keep the allowance. If the ATV gets there first, the allowance does not apply to what you had not declared. For a child of the deceased, that turns an almost token bill into the full tax. That is the real cost of waiting, far more than the surcharge.
If you filed on time but left something out, declare it yourself in a supplementary return before you are asked. How the tax is worked out is covered in inheritance tax in the Valencia region.
The municipal capital gains tax has a deadline too
If the estate includes a flat, commercial premises or an urban plot, there is a second tax: the municipal capital gains tax on land, known as the plusvalía municipal. It is due within six months of the death, extendable up to one year if you ask (article 110.2.b of the Local Finance Act).
If you have missed it, the General Tax Act applies (article 12 of the Local Finance Act): file before the town hall contacts you and you pay the article 27 surcharge, with no penalty. Before paying, check whether there really is a gain: if the land has not gone up in value, there is nothing to pay, but you must declare it and provide the deeds (article 104.5). We explain it in the municipal capital gains tax on an inheritance.
What to do today, step by step
- 1. Check the date. If five months have not passed since the death, ask for the extension. If not, file now: every full month adds 1%.
- 2. Gather the papers. Death certificate, certificate of last wills, the will or the declaration of heirs, and a list of assets with their values. For property, look up the Land Registry reference value.
- 3. File form 650 with everything on it. Every asset, with the allowance claimed.
- 4. Pay when you file, if you can. That gets you the 25% cut on the surcharge. If there is no cash, the bank can pay from the deceased's accounts or you can ask for a deferral. See no money to pay inheritance tax.
- 5. Wait for the surcharge assessment. Pay it on time to keep the reduction.
- 6. Municipal capital gains tax in every town where there is urban property.
Common mistakes
- Hoping the tax office forgets. It has four years to assess the tax, counted from the day after the deadline, and any action of theirs notified to you resets that clock (articles 66, 67 and 68 of the General Tax Act). And without filing you cannot register the property (article 33 of Law 29/1987). If it has been years, read an inheritance left unsettled for years.
- Not filing because "there is nothing to pay". No return means nothing declared, and the allowance only covers what is declared.
When to get help
When a letter from the tax office has already arrived, when more than a year has passed, when you are a sibling or nephew and the bill is significant, or when there is property in several towns. Calculate first, then file.
Frequently asked questions
What happens if I file inheritance tax late in Valencia?
If you file before the ATV asks you to, you only pay a surcharge: 1% plus 1% for each full month late, or 15% plus interest after 12 months (article 27 of the General Tax Act). There is no penalty for paying late and you keep the allowance. If the return shows nothing to pay, there may be a fixed fine of 100 euros (article 198).
Do I lose the 99% allowance if I file late?
No, as long as you file before any demand from the tax office (article 12 bis.3 of Law 13/1997). If they contact you first, you lose it on the assets you had not declared.
Can I ask for an extension after the six months are up?
No. The six-month extension must be requested within the first five months after the death (article 68 of the Inheritance Tax Regulation). In the Valencia region it is done on form 739.
Will I be fined for filing inheritance tax late?
Not for failing to pay, if you file on your own: there is only a surcharge (articles 27 and 191 of the General Tax Act). If the return shows nothing to pay, there may be a fixed fine of 100 euros (article 198.2).
How long do I have for the municipal capital gains tax on an inheritance?
Six months from the death, extendable up to one year if you ask (article 110.2.b of the Local Finance Act).
